Conditions for Participation

1. Subject of the Conditions for Participation.
1.1 Organizer of the Twin Contest 2020 is NEW YORKER MARKETING & MEDIA INTERNATIONAL GMBH, Hansestraße 48, 38112 Braunschweig (hereinafter: the organizer).
1.2 The participants of the contest agree to the following conditions of participation. Participation requires knowledge and acceptance of the conditions of participation. Entries which do not comply with the following conditions or which contain incorrect information may be disqualified by the organizer at any time, without warning and without giving reasons. Prices and other benefits can be refused or reclaimed by the organizer retrospectively.

2. Eligibility to Participate
2.1 All twins who have full legal capacity at the time of their participation are eligible to participate. Persons with limited legal capability who are at least 16 years old are only eligible to participate with the consent of their legal guardian.
2.2 Legal representatives and employees of the organizer are excluded from receiving the prize money.
1.3 Each participant may only partake once. In the case of multiple applications/participation only the first entry will be registered. All further entries under the same surname, first name, date of birth and place of residence will not be considered.
2.4 The organizer reserves the right to check the eligibility of each participant in each individual case. In particular, the organizer may require the participant to present a valid photo ID/identity card.
2.5 The participation is free of charge. Participation and the chance of winning does not depend on the purchase of a certain product.

3. Process and Winnings
3.1 Participation takes place by the applicant sending in a completed registration form, which is displayed by the organizer on their website.
3.2 The registration period begins on 02.02.2020 and runs to 02.05.2020. The end date to register for the Twin Contest 2020 or the deadline for participation is 02.05.2020 24 hrs.
1.3 Participation after the period mentioned under 3.2 will not be considered.
1.4 An internal panel will select the invited contest twins from the submitted applications.
3.5 From all the received applications, a selection of pairs of twins will be invited to participate in the contest (by e-mail) which includes a photo shoot. An internal judging panel will also select the winning pair from the contest. By participating in the competition, participants accept that, here is no right of disclosure of the determination of the winner against the organizer. Before the final winning couple is selected, a shortlist of participants will be invited to Braunschweig for a test shooting. The organizer reserves the right to change the location of the test shooting. The winning couple will be notified by the organizer by e-mail. If the receipt of a prize cannot be provided or if the potential winning couple does not accept the prize or confirm the prize with all its terms and conditions, the potential winning couple loses all rights to the prize.
3.6 The prize includes a photo shoot and a sum of 1.000,00 € per person.
3.7 The confirmation of the prize can be sent by e-mail to modelcontest@newyorker.de. The winning couple must provide the organizer with the signed contract that has been sent to them, otherwise the prize will be withdrawn and a new winning couple will be selected. If the winning pair does not contact the organizer within 5 days after the announcement of the prize, the prize claim expires. In the case of a winning pair under the age of 18 or not legally competent, the name and address of the parents/legal guardians and their written consent is additionally required in order to receive the prize. Any prize that is not formally accepted will not be awarded. Entitlement to a prize will be forfeited if, for any reason beyond the control of the organizer, the prize cannot be delivered to the winning couple within one month of prior notification. Der The winning pair must be available to the organizer for a photo shoot until 06.05.2019, otherwise the claim to the prize money expires. The prize money will be paid out within 30 days of successful participation in the photo shoot to an account to be named by the winner.
3.8 Delivery of the price is free of charge within the Federal Republic of Germany. Any additional costs for further delivery must be paid by the winning pair.
3.9 The participant accepts these conditions of participation by registering on the website. The organizer reserves the right to change, suspend and terminate the registration or the contest at any time without prior notice, without giving reasons, if unforeseen circumstances arise. Such circumstances include in particular the appearance of a virus in the computer system, manipulation or malfunctions in the hardware and/or software, unauthorised intervention by third parties, legal reasons and mechanical or technical problems beyond the control of the organizer. Should such a change be caused by the behaviour of a participant, the organizer has the right to demand compensation from such a person for the damages / loss incurred.

4. Disclaimer
4.1 The organizer shall be liable towards the participant in accordance with the statutory provisions for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty and for other damages caused by an intentional or grossly negligent breach of duty as well as fraudulent intent. In addition, the organizer is liable for damages which are covered by the liability according to mandatory legal regulations, such as the product liability law, as well as in the case of the acceptance of guarantees. In all other cases, the organizer is only liable for slight negligence if he, his legal representatives, executives or other vicarious agents violate a contractual obligation, the fulfillment of which makes the proper execution of the contract possible in the first place, the violation of which endangers the achievement of the purpose of the contract and on the compliance of which the participants could regularly rely. In these cases liability is limited to typical and foreseeable damages. In all other cases the organizer is not liable for slight negligence. In no case is the organizer liable for any indirect damage and/or consequential damage.
4.2 The organizer is not liable for technical problems, such as the Internet connection, lost or delayed e-mail, dysfunction of the website / app or typos.
4.3 By participating, each contestant affirms that he or she is the author of the information and image material submitted, and in particular that this information and image material does not violate any protected intellectual property rights of third parties. Should the participant make incorrect guarantees with regard to the copyright/right of use, which results in damage to the organizer, the participant is liable for damages to the organizer.

5. Data Protection

5.2 The names of the winning pair, their age, gender, place of residence and the winning photo will be published in a press release and on NEW YORKER's social media channels (Facebook, YouTube, Twitter, Google+, Instagram, Pinterest).

6. Cookies
6.1 The internet pages of the organizer use cookies in several places, which are stored by the browser.

7. 5. Jurisdiction
7.1 As far as legally applicable, the place of jurisdiction for disputes in connection with the contest is agreed to be the registered office of the organizer named in section 1.1. The law of the Federal Republic of Germany shall apply exclusively..
7.2 Should individual provisions of these conditions of participation be or become invalid, inadmissible or unenforceable, this shall not affect the validity of the remaining terms of participation. The invalid, inadmissible or unenforceable clause shall be replaced by regulations whose effects come as close as possible to the commercial objective. Any rights arising from the legal relationship on which these conditions of participation are based are not transferable by the participant to third parties. Legal action is excluded.
7.3 The organizer is solely responsible for the contest.
